Today is a great day in L.A. not only because the weather treating us right, but more importantly because U.S. District Judge Vaughn Walker overturned California's ballot decision that prohibited same-sex marriages from taking place. Judge Walker deemed that prop 8 violated the equal protection and due process clauses, and that it failed the rational basis test, a judicial standard of review which analyzes whether or not a particular statute had a rational basis, as opposed to arbitrary, in being enacted.
Today is a big victory for same-sex couples and their supporters! Judge Walker has, however, handed down a stay, which the opposition must respond to by Friday, August 6th. Let's just see how far they can get with an appeal though, because failing the rational basis test doesn't allow much room for argument in their favor!
I guess this means Brad and Angelina can finally get married, eh?
